Official Rules

NO PURCHASE, DONATION, OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A CHARITABLE CONTRIBUTION WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

This Sail the Bay Sweepstakes (“sweepstakes”) is run by O’Neill Sea Odyssey (“sponsor”) a 501(3)(c) non profit. The sweepstakes begin on August 1, 2026, 12:01 AM PST and end on September 15, 2026, 11:59 PM PST (“sweepstakes period”). 

These Official Rules govern the Sweepstakes and constitute the agreement between Sponsor and each Entrant regarding the Sweepstakes.

Eligibility: The sweepstakes is open to legal residents of the United States 18 years or older at the time of entry (“entrant”). Void in NY and where prohibited by law. Sweepstakes are subject to all applicable federal, state, and local laws and regulations and governed by US law. Employees, officers, directors, board members and the immediate families of the O’Neill Sea Odyssey, O’Neill Yacht Charters (“charter operator”), Cannery Row Company, and The Sardine Factory (“prize providers”) are not eligible to enter.

How to Enter: No purchase or donation necessary for entry. Donation does not improve your chances of winning. Method #1 (online): To enter online with a donation, visit https://secure.qgiv.com/for/sailthebaysweepstakes/ Follow all online entry instructions to enter including indicating your voluntary donation amount which corresponds directly to how many sweepstakes entries you wish to submit. Method #2: (postcard): To enter without donation send a hand-written regular-sized postcard (only) with your 1) full name; 2) mailing address (No PO Boxes); 3) telephone number; 4) email address; 5) date of birth; 6) statement, ”I have read and understand all Sail the Bay sweepstakes rules.” to: O’Neill Sea Odyssey, 2222 E Cliff Dr, #222, Santa Cruz, CA 95062. Each postcard is 1 entry and must be mailed individually. All mailed entries must be postmarked between August 1, 2026 and September 15, 2026 and received by September 20, 2026.  Entries that have been tampered, altered, photocopied or mechanically reproduced are not eligible and will be void. Sponsor is not responsible for late, lost, stolen, damaged, garbled, incomplete, illegible, misdirected or postage due mail entries. All entries become Sponsor’s property and will not be returned or acknowledged. Do not send correspondence with your entry. 

Prizes: One (1) Grand Prize: One private two-hour charter for up to 49 people on the Team O’Neill Catamaran. ARV: $3570.00. The Prize includes only the private charter. Food, beverages, gratuities, transportation, parking lodging, incidental expenses and all other expenses not expressly stated are not included and are the Winner’s responsibility. The Prize includes only the private charter and has no cash value. The charter shall be scheduled by mutual agreement between the Winner and the Charter Operator, subject to vessel availability and operational requirements, during the remainder of the 2026 charter season or the 2027 season through November 30, 2027. The Grand Prize is subject to applicable maritime safety requirements. The Captain retains authority over operation of the vessel and may postpone, shorten, relocate, cancel, or terminate the charter whenever, in the Captain’s judgment, weather, sea conditions, mechanical issues, Coast Guard restrictions, passenger safety, or other operational considerations make the voyage inadvisable. If necessary, the charter may be rescheduled during the redemption period. All passengers shall comply with the reasonable instructions of the Captain and crew. Failure to do so may result in termination of the charter without compensation. One (1) 2nd Prize: : A two-night stay in a one-bedroom Deluxe Ocean View Suite at the Monterey Plaza Hotel & Spa, located at 400 Cannery Row, Monterey, California, and a $200 dining certificate toward dinner for two at The Sardine Factory. ARV: $5,800. The hotel stay includes room rate and applicable room taxes only and is subject to availability. The stay is not valid during holidays or special-event dates. Parking, resort fees, transportation, gratuities, incidental charges, meals, beverages, and all other expenses not expressly stated are the Winner’s responsibility. The hotel certificate has no cash value and must be redeemed within one year of the certificate date. Reservations must be arranged in advance. The Sardine Factory dining certificate provides up to $200 toward dinner for two and excludes alcoholic beverages, tax, and gratuity. Any charges exceeding $200 are the Winner’s responsibility. The certificate must be presented to the maître d’ or server at the time of dining, must be redeemed in full during a single visit, and has no refundable or redeemable cash value. No credit or cash will be issued for any unused amount. The certificate must be redeemed within one year of the certificate date. Both components of the Second Prize are subject to their respective provider’s reservation procedures, operating schedules, availability, and customary terms and conditions.

Prizes are non-transferable and no substitution will be offered. Prizes are not redeemable for cash.
Only one prize per person/household. 

Winner Selection and Responsibilities: On September 23, 2026, following the close of the Sweepstakes Period, Sponsor shall conduct a random drawing from among all eligible entries timely received in accordance with these Official Rules. The drawing shall be conducted under the supervision of Sponsor or its designated representatives using procedures reasonably designed to ensure a fair and random selection. 

The odds of winning depend upon the total number of eligible entries received.

Winner Notification and Verification of Eligibility: Sponsor shall make reasonable efforts to notify each potential Winner using the contact information provided on the winning entry. Sponsor shall not be responsible for unsuccessful notification attempts resulting from incomplete, inaccurate, illegible, or outdated contact information supplied by an Entrant. Before awarding a Prize, Sponsor may require the potential Winner to provide reasonable proof of identity, age, residence, and eligibility. Sponsor may also require a declaration of eligibility, a liability release, a publicity release where permitted by law, and any tax documentation reasonably required to administer the Sweepstakes. If a potential Winner is determined to be ineligible, declines the Prize, cannot be contacted after reasonable efforts, or fails to complete required documentation by September 26, 2026 Sponsor may declare the Prize forfeited and select an alternate Winner by random drawing from the remaining eligible entries. Each Winner is solely responsible for any federal, state, or local taxes arising from acceptance or use of a Prize. Sponsor may issue such tax reporting forms as applicable law requires.

Publicity: Except where prohibited by law, acceptance of a Prize constitutes the Winner’s consent for Sponsor to use the Winner’s name, likeness, photograph, voice, and city of residence for promotional or educational purposes relating to Sponsor without additional compensation.

Privacy: Information collected in connection with the Sweepstakes shall be used solely for administration of the Sweepstakes and otherwise handled in accordance with Sponsor’s applicable privacy policy. Entrants may also have the opportunity to sign up to receive promotional emails from parties associated with the Sweepstakes. An entrant’s choice to consent to such emails or to opt out of such emails in future does not impact your chances of winning. 

Force Majeure: Sponsor shall not be responsible for delays, interruptions, cancellations, or inability to perform resulting from events beyond its reasonable control, including acts of God, severe weather, fire, flood, earthquake, public health emergencies, war, terrorism, civil disturbance, utility failures, governmental orders, Coast Guard restrictions, mechanical failures, or other events of force majeure. If such circumstances materially affect administration of the Sweepstakes or fulfillment of a Prize, Sponsor may suspend, modify, substitute, postpone, or terminate the affected portion of the Sweepstakes as Sponsor reasonably determines to be appropriate.

Miscellaneous: By participating in the Sweepstakes, each Entrant releases and holds harmless Sponsor, its directors, officers, employees, volunteers, agents, contractors, prize providers, and representatives from claims arising from participation in the Sweepstakes or acceptance or use of any Prize. 

Sponsor shall resolve questions concerning eligibility, interpretation of these Official Rules, administration of the Sweepstakes, and selection of Winners in good faith. Sponsor’s determinations shall be final.

These Official Rules shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles. Any action arising out of or relating to the Sweepstakes shall be brought exclusively in a state or federal court of competent jurisdiction located in Santa Cruz County, California, unless applicable law provides otherwise.
